Overview
The Subclass 309 Offshore Partner Visa is a temporary visa for the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen. Unlike the 820, you must be outside Australia when the 309 visa is granted (though you can be in Australia when you apply).
The 309 is the first stage of the combined 309/100 offshore partner visa application. Once granted, you can travel to and live in Australia with full work and study rights. After approximately two years from lodgement, your application is automatically reassessed for the permanent Subclass 100 stage.
